More... Parents concerned about possible vaccine dangers and government intrusion are trying to block New Jersey from becoming the first state to require flu shots for preschoolers. The Public Health Council on Monday is set to consider whether New Jersey should require flu shots as well as three additional vaccines. If approved, New Jersey would become the first state to require annual flu shots for children attending licensed preschool or day care centers. State health department officials also want to require a pneumococcal vaccine for preschoolers, a booster shot to fight whooping cough for sixth-graders, and meningitis shots for school children as young as 11. According to deputy health commissioner Dr. Eddy Bresnitz, the new requirements already have been approved by the state health department and Gov. Jon S. Corzine; they are expected to be rubber-stamped by the Council on Monday. Bresnitz said the federal Centers for Disease Control and Prevention supports the new requirements and that public health officials in other states are watching and likely to follow suit. Bresnitz said he's convinced the vaccines will reduce the incidence of the diseases, preventable hospitalizations, and the need for parents to stay home with sick children. "It's a great day for public health in New Jersey," he said. But some parents say there is inadequate proof the vaccines are safe and effective. At a Statehouse news conference Friday, about a dozen parents protested the new requirements and urged people to call the governor's office to ask him to stop Monday's vote. "This will be the first jurisdiction anywhere in the world to make the flu shot mandatory" for school attendance, said Jon Gilmore, a board member of Advocates for Children's Health Affected by Mercury Poisoning, or ACHAMP. He blames his 7-year-old son's autism on vaccines. Bresnitz said he didn't know whether jurisdictions outside this country have required flu shots for school kids. Parents on Friday also urged support for a bill that would give parents a right to "philosophical objection" to vaccine mandates. The bill has been sitting in a committee for four years without action. "It is not right for the government and unelected councils to dictate what we put into our children," said Sue Collins, co-founder of the New Jersey Alliance for Informed Choice in Vaccination. Corzine, asked about the mandates Friday, said he didn't "want to speak to the specifics." CHICAGO (AP) _ Former newspaper mogul Conrad Black, convicted of swindling shareholders in his Hollinger International media empire out of millions of dollars, is due to learn just how steep a price he must pay. Black, 63, a Canadian-born member of the British House of Lords renowned for his lavish lifestyle and flamboyant way with words, faces 6 1/2 to slightly more than 8 years in prison under sentencing guidelines determined Monday. The hearing was in the courtroom of U.S. District Judge Amy J. St. Eve, who presided over his four-month trial earlier this year. Federal prosecutors wanted the silver-haired press lord, a talented biographer whose subjects include Franklin D. Roosevelt and Richard M. Nixon, sent to federal prison for as long as 24 years. Few if any of those close to the trial expected a sentence that stiff. But even half that time would be harsh, especially at Black's age, and prosecutors are all but guaranteed to ask St. Eve to have the former press lord locked up as soon as the sentence is imposed to guard against any temptation on his part to run. Two other former Hollinger executives, both Canadians, and a Chicago lawyer who worked for the big media holding company were convicted along with Black and also were due to be sentenced Monday. While awaiting his sentence, Black has been prevented by court order from returning to Canada and required to remain either in the Chicago area or at his Florida estate. He has been free on $21 million bond. A major point of dispute has been how to calculate the total loss to shareholders. Prosecutors put it at $32 million. But a pre-sentence report, prepared by the probation department, figured the loss at $6 million. The lower number could mean a shorter sentence for Black if St. Eve accepts it. Scores of business executives, politicians and others have written to St. Eve, urging her to show mercy in sentencing the media executive. But there's no guarantee that offers even a glimmer of hope. Black was convicted by a jury July 13 of three counts of mail fraud. He also was convicted of obstruction of justice for removing boxes of documents from his Toronto offices although he knew investigators wanted them. Also convicted on the fraud counts were Jack Boultbee, 64, former Hollinger chief financial officer; Peter Atkinson, 60, former Hollinger executive vice president, and Mark Kipnis, former Hollinger corporate counsel. In its heyday when Black was chairman and CEO, Hollinger International owned the Daily Telegraph of London, the Jerusalem Post, the Chicago Sun-Times and hundreds of U.S. and Canadian community newspapers. Wall Street advanced Monday as expectations for an interest rate cut from the Federal Reserve and an uptick in pending home sales helped offset concerns about another round of subprime mortgage-related losses. Investors remained upbeat ahead of the Fed's rate-setting meeting on Tuesday. Policymakers are broadly expected to lower rates, though economists are still split over whether there will be a quarter-point cut or a half-point cut. The National Association of Realtors gave Wall Street reason to be optimistic about the economy Monday when it said its forward-looking index of U.S. home sales rose in October for the second month in a row. Though investors are still expecting the housing market to remain weak well into 2008, the association is forecasting sales and prices to start recovering modestly next year. The downturn in housing has led to huge losses among banks that invested in securities backed by mortgages, and on Monday, UBS was the latest to reveal large writedowns. The Swiss bank said it will write down some $10 billion of subprime mortgage holdings, which could lead to full-year losses. However, its U.S. shares rose 92 cents, or 1.8 percent, to $51.40 as the bank unveiled plans for an $11.5 billion cash infusion from the government of Singapore and an unidentified Middle Eastern investor. "The financial stocks are leading the way higher because of the UBS news," said Donald Selkin, director of equity research at Joseph Stevens. "There is optimism today that we have seen the worst in the financial sector. There is a feeling that these stocks have already discounted the worst case scenario." The announcement from UBS comes ahead of fourth-quarter earnings from the top U.S. investment banks. Lehman Brothers Holdings Inc. will release results Thursday, while Goldman Sachs Group Inc., Morgan Stanley and Bear Stearns Cos. are scheduled to report next week. In mid-afternoon trading, the Dow Jones industrials rose 84.95, or 0.62 percent, to 13,710.53, after earlier climbing more than 100 points. Broader stock indicators also rose. The Standard & Poor's 500 index rose 9.37, or 0.62 percent, to 1,514.03. The Nasdaq composite index added 13.32, or 0.49 percent, to 2,719.48. Bond prices fell. The 10-year Treasury note's yield, which moves opposite the price, rose to 4.15 percent from 4.12 percent late Friday. The dollar was mixed against other major currencies, and gold prices rose. Wall Street has posted robust gains recently as investors grew more confident in the Fed's openness to loosening its policy again. The Dow has risen more than 640 points over the last two weeks, a rally that has brought the blue-chip index to less than 4 percent below the record close it reached Oct. 9. Last week, the Dow ended 1.90 percent higher, the S&P 500 index finished up 1.59 percent, and the Nasdaq ended up 1.70 percent. In corporate news Monday, Blackstone Group LP might be planning a bid to acquire steel company Rio Tinto Ltd., according to Britain's Daily Telegraph. Blackstone would lead a consortium that would include China's sovereign wealth fund, according to the report. Blackstone rose $1.61, or 7.3 percent, to $23.54, and Rio Tinto rose $6.44, or 1.4 percent, to $474.44. Japanese drug maker Eisai Co. said Monday it will buy U.S. biopharmaceutical company MGI Pharma Inc. for $3.9 billion in a move aimed at boosting its cancer drug business and sustaining sales growth. MGI Pharma rose $6.54, or 19.6 percent, to $39.99. McDonald's Corp., the world's largest fast-food company, said global same-store sales rose 8.2 percent in November. Much of the strength came from overseas, including Europe and Asia. McDonald's, one of the 30 Dow components, rose $1.44 cents, or 2.4 percent, to $61.60. Shares of Dow component Caterpillar Inc. advanced after a Bear Stearns analyst highlighted the construction and farm equipment maker's focus on Chna, where the construction market is expected to keep surging. The stock rose $2.77, or 3.7 percent, to $76.97. Oil prices were volatile amid end-of-year position taking and anticipation of Tuesday's Fed meeting. Light, sweet crude reversed course to trade down 83 cents to $87.45 a barrel on the New York Mercantile Exchange. The Russell 2000 index of smaller companies rose 6.41, or 0.82 percent, to 791.95. Advancing issues outnumbered decliners by about 2 to 1 on the New York Stock Exchange, where volume came to 675.3 million shares. Oil futures fell Monday, reversing course as concerns about falling demand and rising supplies offset earlier anticipation about an interest rate cut. Many investors who had jumped into oil futures markets as crude prices were rising are now looking for opportunities to sell. Many found such an opportunity earlier Monday morning when oil rose to near to near $90 a barrel, said James Cordier, president of Liberty Trading Group, in Tampa, Fla. "Right now, the big question is demand," Cordier said. Several recent reports have suggested domestic demand for oil and gasoline is falling even as OPEC is boosting production. Light, sweet crude for January delivery fell 26 cents to $88.02 a barrel on the New York Mercantile Exchange. While the recent trend of oil prices has been mostly down, trading has been volatile. January futures fell $1.95 on Friday after rising $2.74 on Thursday. "We're covering the same ground and not getting anywhere," said Steve Bellino, senior vice president of energy at MF Global LLC. At the pump, meanwhile, gas prices fell 2 cents over the weekend to a national average of $3.003 a gallon, according to AAA and the Oil Price Information Service. Gas prices have fallen nearly 11 cents from levels reached in mid-November, when oil appeared set to hit $100 a barrel. Oil futures have dropped more than $10 from their highs in recent weeks as OPEC increased output and as demand slid in the face of high prices. Analysts who a month ago were predicting new gas price records now see prices falling well below $3 a gallon in coming months. Some analysts expect oil futures to trade in a range around $90 until more evidence surfaces of either further demand erosion or supply growth. Others believe futures have begun a seasonal move that could take them as low as $70 a barrel. Bank of America is closing off an enhanced money fund to new investors amid withering losses on complex asset-backed securities, the bank said Monday. The Columbia Strategic Cash Portfolio fund for institutional investors that was worth $40 billion only a couple months currently has about $12 billion in assets, Charlotte-based bank said. The loss is related to the subprime-mortgage crisis that has rippled across the globe, Bank of America spokesman Jon Goldstein said. "The conditions have really weakened the performance across the industry, including this one," Goldstein said. The enhanced money fund was a short-term investment pool that offered higher yields than a traditional money-market fund. Bond insurer MBIA Inc. said Monday it will receive a cash infusion of up to $1 billion from private equity firm Warburg Pincus to help bolster its capital reserves as it braces for mounting losses and writedowns in the fourth quarter. The news helped lift MBIA shares by more than 16 percent in afternoon trading. Warburg Pincus will make an initial investment of $500 million by acquiring about 16.1 million shares of MBIA common stock for $31 per share. Warburg Pincus will cover unsubscribed shares worth up to $500 million as part of a shareholder rights offering MBIA is planning for the first quarter of 2008. Warburg Pincus will also receive warrants to potentially purchase an additional 16.1 million shares at $40 per share over the next seven years. MBIA said Friday it was looking for new sources of capital to cover any shortfalls it might have as credit markets have deteriorated over the past few months. Last week, credit rating agency Moody's Investors Service said MBIA is "at greater risk of exhibiting a capital shortfall than previously communicated," and the company's rating could be downgraded. Moody's, Standard & Poor's and Fitch Ratings are all reviewing the financial strength ratings of bond insurers, which sell contracts to reimburse owners of bonds if the issuers fail to repay. As defaults among loans have risen _ especially among subprime mortgages given to customers with poor credit history _ rating agencies began reviewing how those defaults could affect bond insurers. Many securities and bonds are backed by pools of the defaulting loans, meaning defaults among the bonds and securities are more likely. If those bonds and securities default, it would trigger payments by the insurer. Because of the weakening credit markets, MBIA said it will set aside reserves ranging between $500 million and $800 million in the fourth quarter to cover estimates of probable losses. The losses are most likely to come from securities backed by prime home equity lines of credit and close-end home equity loans, MBIA said in a statement. MBIA also said it would take a further writedown on the value of its securities portfolio that is "significantly greater than that of the third quarter." MBIA took a $352.4 million writedown in the third quarter. MBIA said in the statement it would continue to review its capital management options, including reinsurance, issuance of debt and the issuance of securities. As part of the deal, MBIA will also expand its board of directors by two members to 13, allowing Warburg Pincus to nominate two directors. Shares of MBIA rose $4.90, or 16.3 percent, to $34.90 in afternoon trading. The stock has traded between $25.84 and $76.02 in the past year. Unlike traditional money-market funds, the Strategic Cash fund didn't offer investors a guarantee that it would maintain a $1-per-share net asset value, although the fund was managed toward that goal, Goldstein said. The Strategic Cash portfolio was open only to investors with a minimum of $25 million or more. Bank of America Corp. shares were up $1.10, or 2.4 percent, to $46.47 in midday trading. Supporting prices Monday were a weaker dollar, expectations that the Fed will cut rates on Tuesday, which would likely take the dollar down further and news that fog has closed two Texas waterways used by oil tankers. The dollar's continuing decline against the euro and other currencies again made oil look more attractive to foreign investors. Other Nymex futures fell Monday. Heating oil for January delivery fell 1.87 cents to $2.486 a gallon, while January gasoline fell a cent to $2.259 a gallon. January natural gas futures fell 12.5 cents to $7.03 per 1,000 cubic feet on the Nymex. In London, January Brent crude fell 53cents to $88.11 a barrel on the ICE Futures exchange. Overseas, Japan's Nikkei stock average closed down 0.20 percent, while Hong Kong's Hang Seng index fell 1.18 percent. Britain's FTSE 100 rose 0.16 percent, Germany's DAX index rose 0.49 percent, and France's CAC-40 increased 0.56 percent. Black, Atkinson and Boultbee were convicted of paying bonuses to themselves without board approval out of the proceeds from the sale of Hollinger-owned newspapers. The money allegedly was disguised as "non-compete payments" _ payments made by the buyers to guarantee they would not face competition from the former owners. Black was acquitted of nine other charges, including racketeering. A few speakers also said there's no research showing that it is safe to give children all the vaccines required today _ more than 30 for New Jersey children. "They're really being treated as guinea pigs, and not all children can handle all vaccines," said Assemblywoman Charlotte Vandervalk, R-Bergen, sponsor of the philosophical objection bill. By a 7-2 vote, the court said that a 15-year sentence given to Derrick Kimbrough, a black veteran of the 1991 war with Iraq, was acceptable, even though federal sentencing guidelines called for Kimbrough to receive 19 to 22 years. In a separate sentencing case that did not involve crack cocaine, the court also ruled in favor of judicial discretion to impose more lenient sentences than federal guidelines recommend. The challenges to criminal sentences center on a judge's discretion to impose a shorter sentence than is called for in guidelines established by the U.S. Sentencing Commission, at Congress' direction. The guidelines were adopted in the mid-1980s to help produce uniform punishments for similar crimes. The cases are the result of a decision three years ago in which the justices ruled that judges need not strictly follow the sentencing guidelines. Instead, appellate courts would review sentences for reasonableness, although the court has since struggled to define what it meant by that term. Kimbrough's case did not present the justices with the ultimate question of the fairness of the disparity in crack and powder cocaine sentences. Congress wrote the harsher treatment for crack into a law that sets a mandatory minimum five-year prison sentence for trafficking in 5 grams of crack cocaine or 100 times as much cocaine powder. The law also sets maximum terms. Seventy percent of crack defendants are given the mandatory prison terms. Kimbrough is among the remaining 30 percent who, under the guidelines, get even more time in prison because they are convicted of trafficking in more than the amount of crack that triggers the minimum sentences. Justice Ruth Bader Ginsburg, writing for the majority, said, "A reviewing court could not rationally conclude that it was an abuse of discretion" to cut four years off the guidelines-recommended sentence for Kimbrough. Justices Samuel Alito and Clarence Thomas dissented. The Sentencing Commission recently changed the guidelines to reduce the disparity in prison time for the two crimes. New guidelines took effect Nov. 1 after Congress took no action to overturn the change. The commission is scheduled to vote Tuesday afternoon on the retroactive application of the crack cocaine guideline amendment that went into effect on Nov. 1. The commission has estimated 19,500 inmates could apply for sentence reductions under the proposal. Bugs in baby food? Microbes in your milkshake? Relax, this is not the latest tainted food scare _ it's a growing trend in foods designed to boost health, not make you sick. These products contain probiotics, or "friendly" bacteria similar to those found in the human digestive system. There are supplement pills, yogurts, smoothies, snack bars and cereals, even baby formula and chocolate. Sold by major names like Dannon and Kraft, they're spreading like germs on grocery store shelves and in supermarket dairy cases. And they come with vague health claims of "regulating your digestive health" or "strengthening your body's defenses." Experts say probiotics are generally safe, and in some cases might be helpful. More research is needed, and it's a hot new area, reflecting a growing understanding of the role that naturally occurring intestinal bacteria play in health. This week, the National Institutes of Health is hosting a conference where top scientists will discuss recent advances. In the meantime, the market is ahead of the science. It's all part of a burgeoning effort to capitalize on an obsession with health foods. Probiotics are already popular in Europe, Asia and South America. And there are "prebiotics," too, which contain fiber and other nutrients that feed probiotic bacteria. So far this year, more than 150 probiotic and prebiotic commercial food products have been introduced in the U.S., compared with about 100 last year and just 40 in 2005, said Tom Vierhile of Datamonitor, a market research firm. "It is definitely a growing trend," Vierhile said. Holly Maloney, a nutrition instructor at Chicago's Kendall College, eats new probiotic nutrition bars that claim to help digestion and the immune system. She's also a longtime fan of yogurt and kefir, a probiotic-containing fermented milk drink. "It just makes me feel good," Maloney, 32, said of the products. "If I have a few days where I don't have it, I don't feel right." While many probiotic products haven't been put to a rigorous scientific test, there is emerging evidence that in huge amounts, some kinds of "friendly" bacteria can be helpful. Small studies have suggested that certain probiotics might help treat or prevent some types of gastroenteritis, diarrhea and allergic skin reactions, and the bugs are being investigated for many other ailments. The NIH has declared the study of gastrointestinal bacteria and probiotics a major research initiative. The agency's upcoming meeting will highlight current science so it can identify research gaps and determine the direction of future research, said Crystal McDade-Ngutter, who heads an NIH working group on the topic. "The fact that there are a number of health implications and a lack of understanding associated with the use of pre- and probiotics makes this a very interesting subject to study," she said. The bugs are being put under the microscope around the globe. For example: _A Canadian study published last month suggested that fermented milk containing Lactobacillus acidophilus and Lactobacillus caseii could help prevent antibiotic-related diarrhea. _A study from Finland published this year found that an oat drink containing Bifidobacterium lactis bacteria helped bowel function in nursing home residents. _Scientists in Argentina are investigating whether milk fermented with lactic acid bacteria might reduce amounts of cancer-causing substances in the intestine. _University of California at Los Angeles researchers are looking at whether probiotic supplements can treat allergy-induced skin rashes in babies. _Israeli scientists are studying whether these supplements can improve complications in liver disease. Even without all the answers from science, probiotics are a multibillion-dollar global industry. In the United States alone, retail sales of probiotic-containing food and supplements totaled an estimated at $764 million in 2005 and are projected to reach $1 billion in 2010, according to market research firm BCC Research. Dannon's Activia yogurt, introduced last year, is among the best known U.S. products. Its first-year U.S. sales totaled more than $100 million. General Mills introduced its competitor, Yo-Plus, under the Yoplait yogurt brand this year. Other 2007 products include: Kraft Foods Inc.'s LiveActive prebiotic cottage cheese and probiotic cheddar cheese; Nestle's probiotic Good Start Natural Cultures baby formula; Beech-Nut Nutrition Corp.'s Good Evening prebiotic baby food; and the Swiss firm Barry Callebaut's probiotic chocolate. University of Michigan researcher Gary Huffnagle calls probiotics "a new essential food group" in his new book, "The Probiotics Revolution." The concept, however, is not new. Yogurt, made from milk fermented by bacteria, dates back centuries and has been said to have cured a 16th century French king's intestinal illness and to explain longevity in rural Bulgaria. But there's an emerging shift in how scientists view probiotic bacteria and their role in health. Millions of good bacteria live in the intestinal tract, helping keep bad, illness-causing bacteria at bay. Scientists increasingly believe that illness arises when that balance gets out of whack and bad bugs start to take over. This overgrowth has been implicated in many common digestive problems including inflammatory bowel disease and irritable bowel syndrome, said Dr. Sri Komanduri, a gastrointestinal specialist at Chicago's Rush University Medical Center. This line of thinking "has prompted not only the medical industry and obviously the food industry to try to create things to shift the balance back toward that good bacteria," he said. Komanduri prescribes medical-strength probiotic pills containing 450 billion live lactic acid bacteria for inflammatory bowel disease and bacterial overgrowth in the gut. But he doesn't recommend them for patients without specific complaints, and doesn't recommend probiotic foods because he said there's no evidence that they are as effective. Patients who use them and report benefits are likely experiencing a placebo effect, Komanduri said. Commercial products containing probiotics fall under Food and Drug Administration regulations. They are not supposed to make drug-like claims about curing or treating specific illnesses, said FDA spokeswoman Kimberly Rawlings. "As long as they don't cross the line," they can come pretty close, she said. Huffnagle advised consumers to be wary of probiotic-containing products that don't specify how much or what type of bacteria. "If a company says something is probiotic, the question is, how much, and what kind," he said. Evidence suggests the bugs need to be alive and ingested in huge amounts, generally between 5 billion and 10 billion daily, he said. While some products claim to have more, he said it's uncertain whether more is better. In the other case, the court, also by a 7-2 vote, upheld a sentence of probation for Brian Gall for his role in a conspiracy to sell 10,000 pills of ecstasy. U.S. District Judge Robert Pratt of Des Moines, Iowa, determined that Gall had voluntarily quit selling drugs several years before he was implicated, stopped drinking, graduated from college and built a successful business. The guidelines said Gall should have been sent to prison for 30 to 37 months. The sentence was reasonable, Justice John Paul Stevens said in his majority opinion. Alito and Thomas again dissented. Under the decisions in both cases, Alito said, "Sentencing disparities will gradually increase." Chief Justice John Roberts and Justices Stephen Breyer, Anthony Kennedy, Antonin Scalia, David Souter, Ginsburg and Stevens formed the majority in both cases. The cases are Kimbrough v. U.S., 06-6330, and Gall v. U.S., 06-7949. Photos: 2007 Fall Movie Preview Patients who suffer from heartburn are not at increased risk for heart problems as a result of taking Prilosec or Nexium, according to a review released Monday by the Food and Drug Administration. The FDA and its Canadian counterpart began reviewing the drugs, used by tens of millions of people, back in May. The drug's manufacturer, AstraZeneca PLC, provided them with an early analysis of two small studies that suggested the possibility of a risk. The agency said its review of that study as well as 14 others indicated no increased risk for patients. "FDA recommends that health care providers continue to prescribe, and patients continue to use these products as prescribed," the agency said. Nexium is the world's No. 2 selling drug, with 2006 sales of $6.7 billion, according to health care research firm IMS Health. But even if Sierra wanted to sing at the event Friday in Washington, she couldn't. The 22-year-old is being held without bail at the Hillsborough County jail in Tampa on charges of disorderly intoxication and resisting arrest. She is to remain there at least until her next hearing, scheduled Dec. 20. "While we appreciate Ms. Sierra's past efforts to support U.S. troops, including performing for them in Iraq on Independence Day, it is quite obvious that Ms. Sierra needs to devote a great deal of time to putting her life back together," Retired Air Force Lt. Col. Buzz Patterson said in a statement released Friday. In a brief phone interview Sunday, Patterson said patrons of MoveAmericaForward.org, which is coordinating the concert, were concerned about Sierra's participation in the event.
